Terms of Use

1. Definitions

"Service" means the Bagheera website and mobile app. "User" means any person using the Service. "Organizer" means a User who creates or manages events or venues. "Content" means any text, images, data, or other material uploaded or displayed through the Service. "Subscription" means any paid plan offered by Bagheera.

2. Eligibility and account

You must be at least 16 years old to create an account, or have consent from a legal guardian if required by law. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You must provide accurate and up-to-date information. We may suspend or terminate accounts that contain false information or are used in breach of these Terms.

We may change, suspend, or discontinue parts of the Service at any time. We will make reasonable efforts to inform users of significant changes.

You are responsible for ensuring that your device, software, and internet connection are suitable for using the Service.

3. User content and licenses

You retain ownership of your Content. By uploading or publishing Content, you grant Bagheera a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and make your Content available as necessary to provide and promote the Service.

You represent that you have the necessary rights to the Content you upload, including image rights, music rights, and permissions from third parties.

We may remove Content that violates these Terms, applicable law, or third-party rights, or that is misleading, harmful, or inappropriate.

You are responsible for the accuracy of event details, pricing, schedules, and other information you publish.

If you delete Content or your account, we will make reasonable efforts to remove public display of that Content, except where retention is required by law or for legitimate business purposes.

4. Acceptable use

You must not use the Service in a way that violates law, infringes rights, or harms others.

In particular, you agree not to:

• Publish illegal, defamatory, hateful, or discriminatory content
• Upload malware, attempt to disrupt the Service, or access systems without authorization
• Collect data from the Service without permission (scraping)
• Impersonate others or misrepresent your affiliation
• Use the Service for unsolicited marketing without consent

We may take appropriate action, including removing content or suspending accounts, to enforce these rules.

5. Subscriptions and payments

Some features require a paid Subscription. Pricing and billing terms are presented at the time of purchase.

Payments are processed by Stripe. We do not store card details. Stripe may collect and process your payment information under its own terms and privacy policy.

Subscriptions renew automatically unless cancelled before the end of the current billing period. You can manage or cancel your Subscription in your account settings.

Unless otherwise stated, fees are non-refundable, except where required by mandatory consumer law.

We may change pricing with advance notice. Changes will take effect at the next renewal unless otherwise specified.

If payment fails, we may suspend or downgrade your Subscription until payment is resolved.

6. Limitation of liability

The Service is provided "as is" and "as available". We do not guarantee uninterrupted access, error-free operation, or that Content is accurate.

Bagheera is not responsible for events, venues, or third-party services listed on the Service. Organizers are solely responsible for their events and compliance with law.

To the maximum extent permitted by law, Bagheera is not liable for indirect, incidental, or consequential losses, including loss of profit or data.

Nothing in these Terms limits liability for intent or gross negligence, or any liability that cannot be excluded under Norwegian law.

7. Privacy and data protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including GDPR.

You are responsible for ensuring that any personal data you upload is collected lawfully and that you have a valid legal basis to share it.

If you use the Service as an organizer and process personal data about participants, you may be considered a data controller and must comply with GDPR obligations.

8. Termination

You may close your account at any time through your account settings or by contacting us.

We may suspend or terminate your account if you breach these Terms, misuse the Service, or if required by law.

Upon termination, your access to the Service will end. We may retain data where required by law or for legitimate business purposes.

Sections that by their nature should survive termination (including licenses, liability, and governing law) will remain in effect.

9. Intellectual property

Bagheera and its logos, design, and software are protected by intellectual property laws. You may not copy, modify, or distribute our materials without permission.

You retain rights to your Content, subject to the license granted to us under these Terms.

10. Third-party services

The Service may include or rely on third-party services (e.g., maps, payments, analytics). These services are governed by their own terms and privacy policies.

We are not responsible for the availability, functionality, or content of third-party services.

11. Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, war, or outages.

12. Governing law and disputes

These Terms are governed by Norwegian law. Disputes shall be resolved in Norwegian courts, unless mandatory consumer protection rules provide otherwise.

Consumers in the EEA may also use alternative dispute resolution mechanisms provided by their local authorities.
